1. Who is responsible for your information?

Mark Phillips Fitness, trading as ShapeShifters AI, is the data controller for the personal information used to provide ShapeShifters Pro.

2. Information we may collect

• Identity and contact details, including your name, email address and telephone number.
• Membership, payment status and transaction records. Card details are handled by the payment provider and are not stored by ShapeShifters.
• Your goals, measurements, dietary preferences, food dislikes, allergies or intolerances, activity, training experience and lifestyle information.
• Progress check-ins, messages, feedback and records of the plans supplied to you.
• Basic website and device information when analytics or essential security tools are enabled.

Some questionnaire answers may reveal health-related information. We only ask for information relevant to providing the service and use additional safeguards where required.

3. Why we use it

• To administer your membership and provide the service you purchased.
• To create, review and update your personalised targets, meal plans, shopping lists, activity guidance and priorities.
• To communicate with you about onboarding, reviews, support, payments and material service changes.
• To keep appropriate business, safety and financial records and meet legal obligations.
• To improve the service using aggregated or appropriately minimised information.

Our main lawful bases are performing our contract with you, complying with legal obligations and our legitimate interests in operating and improving the service. Where special-category information is involved, we will identify and record an appropriate additional condition or obtain explicit consent where required.

4. AI and professional review

Technology helps organise and generate parts of your plan from the information you provide. ShapeShifters Pro is designed to include professional oversight. Automated output should not be treated as a medical diagnosis or a replacement for professional healthcare.

5. Who information may be shared with

Information may be processed by carefully selected providers that support payments, questionnaires, communications, document generation, hosting, analytics or secure storage. They should only process it for authorised purposes and under appropriate safeguards. We may also disclose information where the law requires it or to protect someone from serious harm.

We do not sell your personal information.

6. Retention and international processing

We retain information only for as long as needed for membership delivery, support, legal, tax, insurance and dispute-handling purposes. Different records may have different retention periods. Where a provider processes information outside the UK, we use an appropriate lawful transfer safeguard where required.

7. Your rights

Depending on the circumstances, you may ask for access, correction, deletion, restriction, portability or object to certain uses of your information. You may withdraw consent where processing relies on consent. Contact us to make a request. You also have the right to complain to the UK Information Commissioner’s Office.

8. Cookies and marketing

The site may use strictly necessary technology for security and operation. Optional analytics or advertising cookies will require an appropriate notice and choice before they are activated. We will only send electronic marketing where permitted, and every marketing message will provide a way to opt out.
